Terms & Conditions of Sale
BIDDING - The highest accepted bidder to be the purchaser subject to reserve price being met. In the case of dispute the lot to be put up again at the last undisputed bidding, or the Auctioneer may declare the purchaser. The bidding to be regulated by the Auctioneer who shall be the sole arbitrator in any dispute. The Auctioneer reserves the right to refuse any bid, to sell the lots in such order as he may think convenient, to withdraw any lot, to group together, and to bid on behalf of the vendor. A bid will not be accepted once the hammer has fallen. By bidding the bidder is deemed to have read and understood the terms and conditions of sale.
ADDRESS - Potential bidders are to give their name, telephone number and full address when registering, this information will not be used for any other reason other than Health and Fire Regulations.
DELIVERY - Each lot is at the purchaser’s risk at the fall of the hammer and must be removed with all faults, defects and errors immediately following the conclusion of the sale. Only the porters shall remove items from the sale area. A porter will be available during and after the auction to collect sold lots on behalf of the purchaser. No lots may be removed by the purchaser until the whole amount of his bill has been paid and the delivery slip checked by the porter.
DESCRIPTION - The Auctioneer acts as agent only. Each lot as set out in the catalogue, or as divided or joined with any lot or lots at the sale at the sole discretion of the Auctioneer, is sold with all faults, imperfections, any errors of description and neither the vendor nor the Auctioneer is responsible for the authenticity, period, condition or quality of any lot. All statements in the catalogue as to any such matters are statements of opinion and are not to be taken as or implying statements or representation of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any lot. Neither vendor nor the Auctioneer make or give any representation or warranty or for any statement in the catalogue.
DAMAGE - Any damage caused during the view and sale, or during the period of removal must be made good by the person causing the damage.
REMOVAL - All goods must be cleared from the saleroom by the vendor immediately following the conclusion of the sale unless prior arrangements have been made with the desk. Carousel reserves the right to immediately dispose of any 'no reserve' lots that have not been collected at the end of the sale and where there has been no prior agreement about their disposal. In cases with no prior agreement, there will be a fee equivalent to 30% of the reserve price for each lot payable by the vendor for storage and insurance of uncollected items.
DEFAULT - As the Auctioneer acts as agent only, he disclaims responsibility for any default on the part of either the Vendor or Purchaser. Vendors are not paid until payment is received for their items.
CHEQUES - Payment by cheque will need to be cleared and agreed in advance with the office. Carousel reserves the right to refuse payment by cheque.
BUYER'S PREMIUM -The purchaser shall pay Welwyn Auctions a premium of 12% on the hammer price with a minimum of £1.20 per lot, plus 50 pence administration fee per lot. Commission bids may be left with the office prior to the auction starting and must be paid for and collected by the end of the sale unless otherwise agreed with the office.
VENDORS. Lotting fee £3 per lot entered, 12% of the hammer price will be subtracted as commission, all un-sold lots must be cleared by the vendor at the end of the sale. Once viewing has commenced lots may only be withdrawn from the sale at the absolute discretion of the Auctioneer. All sellers are required to deliver their lots between 12 noon - 1pm. Any lots delivered after 1pm may result in them not being included and sellers will be liable to pay lotting fees. Sellers are also reminded that lots need to be picked up at the end of the auction if unsold. Any lots that are not picked up on the night without prior arrangement may be disposed of at the Auction’s discretion. At the seller's request and entirely at the seller's own risk, Carousel may take any unsold lots to a future auction if deemed appropriate.
PAYMENTS. Payments to vendors will be made by either BACS transfer or cheque. Cash payments will only be made by agreed prior arrangement with Carousel. Please be aware that BACS transfers may take up 3-4 working days . Please also read our default section as above.
